Rules and Regulations
The Rules and Regulations hereinafter enumerated as to the
Corporation Common Areas shall be deemed in effect until amended by the
Board of Governors ("Board") of Eagle Trace Community Association,
Inc. ("Corporation") and shall apply to and be binding upon
all Owners. The Owners shall, at all times, obey said Rules and Regulations
and shall be held responsible for seeing that they are faithfully observed
by their families, guests, invitees, servants, lessees and persons over
whom they exercise control and supervision. The definitions contained
in the Declaration and General Protective Covenants for Eagle Trace Community
(recorded at Official Records Book 11230, Page 152 of the Public Records
of Broward County, Florida) are incorporated herein by reference.
1. All speed limits
shall be obeyed. Unless otherwise posted with a speed limit sign, the
speed limit on all streets shall be 25 mph.
2. There shall be
no overnight parking of vehicles along streets by Owners
or guests. In the event Owner shall deem it necessary to request temporary
overnight on-street parking, management company must be notified at least
three days prior to the date that additional parking is required. If such
parking shall be deemed a nuisance approval may be withheld.
3. No sign, advertisement,
notice or other lettering shall be exhibited, displayed, inscribed, painted,
posted or affixed in, on or upon any part of an Owners property, nor the
Corporation Common Areas. The foregoing includes posters, or circulars
to Dwelling Units within Eagle Trace.
4. There shall be
no vending, peddling or soliciting orders for sale or distribution of
any merchandise, devices, services, periodicals, books, pamphlets, or
other matter in Eagle Trace whatsoever. There shall be no garage or lawn
sales, or the like.
5. The Corporation
Common Areas shall not be used for any type of business or commercial
purposes.
6. The Corporation
Common Areas shall not be obstructed, abused, defaced or littered by an
Owner or his guests, agents, servants employees or invitees, or used by
them for any purpose.
7. No Owner or occupant
shall direct, supervise or in any manner attempt to assert any control
over any of the employees of the Corporation, Management Company or Gatehouse
Staff.
8. No visitors shall
be permitted in Eagle Trace unless, upon telephone inquiry from the Gatehouse,
specific permission is received allowing the visitors to enter and to
proceed DIRECTLY to a resident's Dwelling Unit. Residents
should call the Gatehouse in advance to expedite admission, if the guest
is expected.
9. Residents shall
not permit visitors to use the resident's name to enter Eagle Trace for
the purpose of touring through the Community.
10. Commercial vehicles must use the east and west gates only between 8:00 a.m. and 6:00 p.m. on weekdays and 8:00 a.m. to 1-00 p.m. on Saturdays. No construction, maintenance or repair work shall be permitted on Sundays, New Years Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving or Christmas Day, except in the event of emergency repairs.
11. No outdoors-game
court lighting except patio and pool lighting shall be permitted after
10:00 p.m.
12. Pet owners shall
curb their pets and are responsible for cleanup of their pet's waste.
All pets shall be kept on a leash at all times when off the Owner's premises.
Any droppings shall be picked up by the pet owner and properly disposed
of. Should the owner violate Broward Code S.4-8 by not picking up their
pet's waste they will be cited under civil penalties Sec, 4-29 and may
pay an enforceable fine.
13. No go-cart,
mini-bike, dirt bike, all terrain cycle (ATC), or any other unlicensed
motorized vehicle or conveyance shall be operated on the Corporation Common
Area. This rule is in addition to, and not in limitation of, any other
restrictions contained in these rules or in the Declaration and General
Protective Covenants for Eagle Trace Community.
14. Golf carts shall
only be used for the purpose of gaining access to and egress from the
clubhouse, and shall only be used for such purpose on Roadways within
the Corporation Common Areas, and shall only be used during daylight hours.
Only electric-powered golf carts shall be permitted. No golf cart which
is required by applicable law to be registered and/or bear a license plate
shall be permitted unless such requirements have been met. ANY
PERSONS OPERATING A GOLF CART ON THE CORPORATION COMMON AREA SHALL DO
SO AT THEIR OWN RISK and shall hold harmless Declarant and the
Corporation from any claim or loss arising from such use.
15. Each owner who
leases his/her Dwelling Unit shall, within fifteen (15) days after entering
into a lease, deliver to the Secretary of the Corporation a copy of such
lease or, in writing, the following information- lessor, lessee, address,
and beginning and ending dates of the lease. Such lease or written information
shall be used by the Corporation solely for the purpose of prohibiting
access of unauthorized persons.
16. Security access mechanisms
(gate openers) shall be issued only to residents who have photo identification
that shows the Eagle Trace address. Gate openers are NOT issued to vehicles.
Exceptions to this must be approved by the Board of Governors.
17. All landscaping
in common areas and on private parcels is strictly regulated under the
Eagle Trace Community deed restrictions and covenants and Coral Springs
landscape regulations. All new landscaping must be submitted with a landscape
plan in accordance with these regulations. Existing landscape MAY
NOT be changed without submitting a plan of the proposed changes
to the Board of Governors of Eagle Trace and will be reviewed by the Landscape
Committee.
18. There shall
be established an architectural review committee.
19. All exterior paint colors must be approved by the City of
Coral Springs prior to the request being submitted to the Board of Governors.
All Paint change requests must include an: Architectural Application,
Approved City of Coral Springs Paint permit application; and color samples.
20. All architectural changes
or proposed architectural changes i.e. renovations, as well as, installation
of recreational equipment must be formally submitted to the board for
approval. This shall also be deemed to include existing architectural
elements such as roof, driveway, windows, doors, etc.; This also includes
proposed replacement of such architectural elements such as roofs. All
proposed changes must be filed with the board of governors in writing
with appropriate plans, permits and product information (30) days in advance
of any planned work.
21. Member's assessments
shall be paid promptly. Failure to comply may result in additional expenses
to the owner.
22. The Board reserves
the right to amend, supplement and/or modify these Rules and Regulations
and to make such other rules and regulations as in its judgment may, from
time to time, be necessary for the safety and cleanliness of, for the
preservation of good order, in aesthetic enhancement thereof and the efficient
operation of, Eagle Trace.
